Fableform LLC (“Fableform,” “we,” “us,” or “our”) operates the Fableform platform, website (fableform.ai), desktop application, and related services (collectively, the “Service”). This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our Service.

By accessing or using Fableform, you agree to this Privacy Policy. If you do not agree, please do not use the Service.

1. Information We Collect

1.1 Information You Provide

• Account Information: Name, email address, password, and optional profile details when you create an account.
• Payment Information: Billing address and payment method details processed through our third-party payment processor. We do not store full credit card numbers on our servers.
• Content and Projects: Screenplays, images, videos, audio files, text prompts, project configurations, and other creative materials you upload or generate through the Service.
• Communications: Messages you send to us via email, contact forms, or in-app support channels.

1.2 Information Collected Automatically

• Usage Data: Features used, generation requests made, pages visited, timestamps, session duration, and interaction patterns.
• Device and Technical Data: IP address, browser type, operating system, device identifiers, and screen resolution.
• Log Data: Server logs including access times, error reports, and referring URLs.
• Cookies and Similar Technologies: We use cookies, local storage, and similar technologies for authentication, preferences, and analytics. See Section 7 for details.

1.3 Information from Third Parties

• Authentication Providers: If you sign in via a third-party service, we receive your name, email, and profile image as authorized by that provider.
• Analytics Services: We use privacy-respecting analytics to understand aggregate usage patterns.

2. How We Use Your Information

We use the information we collect to:

• Provide, maintain, and improve the Service
• Process transactions and manage your account
• Route generation requests to AI providers on your behalf
• Maintain visual continuity and project memory within your projects
• Send transactional communications (receipts, account updates, security alerts)
• Send marketing communications (only with your consent; you may opt out at any time)
• Monitor for abuse, fraud, and violations of our Terms of Use
• Comply with legal obligations
• Improve our algorithms, infrastructure, and user experience through aggregated, de-identified usage analytics

3. How We Share Your Information

We do not sell your personal information. We share information only in the following circumstances:

3.1 Service Providers

We share data with third-party vendors who perform services on our behalf, including:

• AI Generation Providers: Your text prompts and reference images are transmitted to third-party AI providers to fulfill generation requests. These transmissions are governed by our data processing agreements with each provider. See Section 5 regarding AI training.
• Payment Processing: Your payment information is processed by our payment provider under their own privacy policy.
• Cloud Infrastructure: Our servers and databases are hosted on secure cloud infrastructure.
• Blockchain Services: On-chain IP registration data is recorded on a public blockchain. Blockchain transactions are inherently public.

3.2 Legal Requirements

We may disclose your information if required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Fableform, our users, or the public.

3.3 Business Transfers

In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.

3.4 With Your Consent

We may share information for other purposes with your explicit consent.

4. Data Retention

We retain your information for as long as your account is active or as needed to provide the Service. Specifically:

• Account data: Retained until you delete your account.
• Project data: Retained until you delete the project or your account. You may export your projects at any time.
• Generation logs and billing records: Retained for 7 years for financial compliance.
• Server logs: Retained for up to 90 days.

Upon account deletion, we will remove your personal data within 30 days, except where retention is required by law or necessary for legitimate business purposes (e.g., fraud prevention, financial records).

5. AI Training and Your Content

Fableform does not use your content to train AI models.

Your screenplays, images, videos, prompts, and generated outputs are never used to train, fine-tune, or improve any AI model, whether ours or any third-party provider's. Your creative work remains yours.

When we transmit your prompts and reference images to AI generation providers, those transmissions are governed by enterprise Data Processing Agreements (DPAs) that contractually prohibit the use of your data for model training. We select and negotiate with providers specifically on this basis.

The visual continuity memory stored in your projects is used solely to maintain consistency within your own productions and is never shared across accounts or used for any purpose other than serving your project.

6. Data Security

We implement commercially reasonable technical and organizational measures to protect your information, including:

• Encryption in transit and at rest
• Token-based authentication with secure handling
• Secrets management isolated from application code
• Role-based access controls
• Regular security assessments
• DPA agreements with all AI generation providers

No system is completely secure. While we strive to protect your data, we cannot guarantee absolute security.

7. Cookies and Tracking Technologies

We use cookies and similar technologies for:

• Essential Cookies: Authentication, session management, security. Required for the Service to function.
• Preference Cookies: Remembering your settings and preferences.
• Analytics Cookies: Understanding aggregate usage patterns to improve the Service. We use privacy-respecting analytics tools.

We do not use advertising cookies or sell data to advertisers. You can manage cookie preferences through your browser settings. Disabling essential cookies may impair Service functionality.

8. Your Rights and Choices

Depending on your jurisdiction, you may have the following rights:

• Access: Request a copy of the personal data we hold about you.
• Correction: Request correction of inaccurate data.
• Deletion: Request deletion of your personal data, subject to legal retention requirements.
• Portability: Request an export of your data in a machine-readable format.
• Opt-Out: Opt out of marketing communications at any time.
• Objection: Object to certain processing activities where permitted by law.

California Residents (CCPA)

If you are located in the European Economic Area, our legal bases for processing include: performance of our contract with you, your consent, our legitimate business interests, and compliance with legal obligations. You have the right to lodge a complaint with your local supervisory authority.

9. Children's Privacy

Fableform is not intended for children under the age of 16. We do not knowingly collect personal information from children. If we become aware that we have collected data from a child under 16, we will delete it promptly.

10. International Data Transfers

Fableform is operated from the United States. If you access the Service from outside the United States, your information may be transferred to and processed in the United States. By using the Service, you consent to this transfer.

11. Third-Party Links

The Service may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on our website and updating the “Last Updated” date. Your continued use of the Service after changes constitutes acceptance of the updated policy.
