Acceptable Use Policy

This Acceptable Use Policy ("AUP") is incorporated into and forms part of the Fableform Terms of Service. By accessing or using Fableform's services (the "Services"), you agree to be bound by this AUP. Violations may result in suspension or termination of your account under our Terms of Service, and where applicable, referral to law enforcement.

Fableform is built for professional filmmakers, commercial directors, and studio clients. Difficult subject matter is a legitimate part of professional film and commercial production, and this AUP is written with that in mind. The categories below are prohibited regardless of artistic, satirical, journalistic, educational, or research framing, except where this AUP expressly says otherwise.

1. Definitions

  • "Minor" means any person under the age of 18, or under the age of majority in the relevant jurisdiction, whichever is higher.
  • "Content" means any text, image, video, audio, model, prompt, or other material generated, uploaded, hosted, transmitted, or distributed through the Services.
  • "Identifiable person" means a natural person, living or deceased, who can be recognized, directly or indirectly, from the Content, including by facial likeness, name, voice, gestures, mannerisms, or other personal attributes or other distinguishing characteristics.
  • "Likeness" means the name, image, photograph, voice, vocal style, signature, gestures, mannerisms, or other personal attributes that identify or are identifiable to a natural person, living or deceased.
  • "Third-Party Model" and "Provider Policies" have the meanings given in the Terms of Service.

2. Prohibited Content

You may not use the Services to generate, upload, host, transmit, or distribute Content that constitutes or contains:

  • Child Sexual Abuse Material (CSAM). Any depiction — generated, drawn, photographed, or otherwise produced — of a minor in a sexual or sexualized context, or any Content that sexualizes, solicits, grooms, or otherwise facilitates the exploitation of minors. Fableform reports all detected CSAM to the National Center for Missing & Exploited Children (NCMEC) as required by 18 U.S.C. § 2258A.
  • Likeness of minors. Any use of the face, voice, or other Likeness of a real Minor, whether or not sexual, and any depiction of Minors in connection with violence, abuse, exploitation, grooming, or any other harmful or offensive manner except as expressly permitted under a written agreement with Fableform that includes verified parental or guardian consent.
  • Sexually Explicity Content. Pornographic or sexually explicit content, including depictions of sexual acts, sexual contact, or genitalia, whether photorealistic, animated, illustrated, or AI-generated; and any non-consensual intimate imagery, including non-consensual deepfakes, revenge pornography, and content depicting sexual violence or coercion.
  • Gratuitous violence. Real-world graphic violence designed to celebrate or incite violence; gratuitous gore or torture; and detailed depictions of violent harm against identifiable real persons or groups. Depictions of violence in legitimate film, television, advertising, journalism, or art are not categorically prohibited, but are subject to review and to any stricter Provider Policies (see Section 7).
  • Hate speech and harassment. Content that promotes violence against, threatens, or dehumanizes individuals or groups based on race, ethnicity, national origin, religion, sex, sexual orientation, gender identity, disability, or other protected characteristics.
  • Violent extremism. Content that incites, glorifies, or promotes terrorism, violent extremism, insurrection, mass violence, or genocide, or that provides operational instructions for attacks on persons, infrastructure, or property.
  • Self-harm content. Material that encourages, glorifies, or provides instructions for suicide, self-injury, or eating disorders. Fictional treatments of these subjects in legitimate creative works are permitted only where they follow industry safe-messaging guidelines and applicable law.
  • Weapons and dangerous goods. Operational instructions for the manufacture, modification, or deployment of weapons of mass harm, including firearms conversions, explosives, chemical weapons, biological agents, or radiological devices.
  • Illegal drugs. Content that facilitates the synthesis, distribution, or sale of controlled substances.
  • Fraud and deception. Phishing content, fraudulent identification, counterfeit documents, or materials intended to deceive others for financial gain (see also Section 5).
  • Agentic AI, Malware and exploits. Agentic AI, code or content designed to compromise the security of computer systems or networks.

Additionally, you may not use Services in any way that could cause harm to Fableform’s business, reputation, interests and/or integrity.

3. Identity and Likeness

You may not generate, upload, or alter Content depicting the Likeness of an identifiable real person — including celebrities, public figures, and private individuals, living or deceased — unless: (a) the person is you; or (b) you hold that person's verifiable, informed, written consent (or, for a deceased person, consent from the lawful holder of post-mortem publicity or other requisite proprietary rights) that expressly covers the AI-generated nature of the Content and the contexts, platforms, and duration of its use. Generation of unauthorized likeness is a violation of right-of-publicity laws and/or other proprietary rights (including biometrics) in many jurisdictions and is a basis for immediate account suspension.

Voice. You may not clone, synthesize, imitate, or replicate the voice or vocal style of any real person, living or deceased, without that person's verifiable, informed, written consent. This applies whether the synthesis is generated from a sample, a description, or any other means, and includes voiceover, dialogue replacement, and audio in video Content.

Limited exceptions apply to celebrity-clearance users — typically licensed talent representatives or rights-holders who have a verified relationship with the depicted person. To apply for clearance, contact legal@fableform.ai.

Fableform, in its sole and absolute discretion, may refuse, remove, or block any Content depicting a real person (living or deceased), regardless of consent, where it reasonably believes that the Content presents legal, reputational, or safety risk. Some Third-Party Models do not permit any depiction of real people; those restrictions apply even where you hold consent (see Section 7). You are solely responsible for complying with right-of-publicity, likeness, biometrics, and all other relevant applicable laws, including California Civil Code Sections 3344 and 3344.1, New York Civil Rights Law Sections 50 and 51, and comparable laws in other jurisdictions.

4. Intellectual Property

You may not use the Services to generate Content that infringes the copyright, trademark, or other intellectual property or proprietary rights of third parties, including but not limited to copying protected characters or trade dress where such use infringes any such protected rights. Fableform reserves the right to terminate the Services of infringers under our DMCA policy — see /dmca. Copyright and trademark inquiries should be directed to legal@fableform.ai.

Without limiting the foregoing, you may not: (a) reproduce or imitate copyrighted characters, costumes, sets, props, music, or other protected elements of third-party works without authorization; (b) recreate the protectable expression of identifiable artists, cinematographers, designers, or composers, including by prompting with their names or distinctive style markers, without permission; (c) circumvent technological protection measures or rights management information; or (d) submit reference images, footage, or audio that you do not own or are not licensed to use for the relevant purpose.

5. Deception, Elections, and AI Disclosure

You may not use the Services to:

  • create or distribute Content intended to deceive a person into believing it is authentic, unaltered, or attributable to a person who did not create or authorize it, including non-consensual deepfakes of real people;
  • impersonate any person, business, organization, government official, or government agency without authorization;
  • falsify or simulate evidence, testimony, news reports, judicial proceedings, public records, or government communications, or pass off Content as a recording of a real event that did not occur, unless it is reasonably believed to be, and clearly identified as, fictional, satirical, or AI-generated and is otherwise legal;
  • interfere with elections, voting, or referenda; mislead voters about voting times, places, methods, or eligibility; create deepfakes of candidates or public figures in connection with political campaigns; or otherwise incite any violence or insurrection;
  • represent Content as human-created when it is wholly or substantially AI-generated, where that representation is material to the audience or disclosure is required by law, contract, or applicable industry standard (including standards published by SAG-AFTRA, the DGA, the WGA, or the AMPTP), or submit AI-generated Content to awards, festivals, or registries that require disclosure without making it; or
  • remove, alter, obscure, or interfere with provenance metadata, content credentials, watermarks, or similar markers applied to Content by Fableform or by a Third-Party Model, except as expressly authorized by Fableform in writing.

Where law requires AI-generated Content to be labeled or disclosed, you are responsible for doing so.

6. Privacy and Sensitive Uses

You may not use the Services to:

  • build or augment facial recognition or biometric identification databases, or conduct biometric identification of individuals;
  • infer sensitive characteristics of identifiable individuals, such as health, sexual orientation, religious beliefs, political views, or immigration status;
  • track, monitor, profile, or stalk individuals, or collect personal information about other users without their consent;
  • provide medical, clinical, legal, or financial advice, or make decisions with legal or similarly potential significant effects on individuals, such as decisions about credit, employment, housing, insurance, education, immigration, or healthcare; or
  • send spam, phishing content, or other unsolicited or unlawful communications.

7. Model-Specific Restrictions

Each Third-Party Model available through the Services is also governed by its provider's Provider Policies, which Fableform identifies in the Services. Some Third-Party Model providers impose restrictions stricter than this AUP — for example, prohibiting political content, any depiction of real people, or certain violent, sexually explicit, or mature themes. When you use a Third-Party Model, the stricter of this AUP and that Third-Party Model's Provider Policies applies. Fableform may block requests to a Third-Party Model that would violate its Provider Policies, and may restrict your access to a Third-Party Model to protect the Services for all users.

You may not use the Services or any Output to develop, train, or improve any artificial intelligence model, as further described in the Terms of Service.

8. Service Integrity

You may not:

  • Attempt to circumvent content moderation, rate limiting, or other technical controls.
  • Probe, scan, or test the vulnerability of any system or network without prior written authorization from Fableform.
  • Use the Services to attack, disrupt, or degrade any other system or service.
  • Scrape, harvest, or otherwise collect Content from the Services in violation of these terms or applicable law.

9. Account Responsibility

You are responsible for all activity that occurs under your account, including the conduct of any end users who access the Services through your account, applications, or software integrations. If you make the Services available to end users, you must impose terms at least as protective as this AUP and remain responsible for their compliance. You must promptly notify Fableform of any unauthorized use of your account or credentials.

10. Enforcement

Fableform may, at its sole discretion: (a) remove or restrict access to violating Content; (b) suspend or terminate accounts; (c) refuse service; and (d) report violations to law enforcement, NCMEC, or other appropriate authorities. Reactivation of a suspended account requires individual review by an administrator.

The categories in this AUP are not exhaustive. Fableform may act against conduct that, in its reasonable judgment, violates the spirit of this AUP, threatens the safety of users or third parties, or exposes Fableform or its Third-Party Model providers to legal, reputational, or operational risk.

We may modify this AUP at any time. Material changes will be communicated via email or in-product notice. Continued use of the Services after a change constitutes acceptance of the modified AUP.

11. Appeals

If you believe Fableform has taken action in connection with your account or Content in error, you may request review by contacting legal@fableform.ai within 30 days of the action. Your request should identify the affected account or Content and explain the basis for the appeal. Fableform will review eligible appeals and communicate a decision within a reasonable period. This appeals process does not apply to actions taken in response to CSAM, which are non-appealable and reported as required by law.

12. Reporting Violations

Report suspected AUP violations to reportabuse@fableform.ai. Reports related to alleged copyright or trademark infringement should follow our DMCA process and may be directed to legal@fableform.ai. General customer support is available at support@fableform.ai.

13. Governing Law

This AUP is governed by and incorporated into the Fableform Terms of Service, including its governing law, jurisdiction, and dispute-resolution provisions. In the event of a conflict between this AUP and the Terms of Service, the Terms of Service control.
